RE: The tariff classification of gloves from Korea.

Dear Ms. Feagans:

In your letter dated October 26, 1999, you requested a classification ruling on behalf of STK International Inc.

Five glove samples were provided for review. Style WG-109 is a cotton string-knit glove with a PVC dot coating covering the palmside from fingertips to wrist. The PVC dot coating weighs less then 50% of the glove weight. The glove features a ribbed knit cuff with an overlock stitch finish.

Style WG-103 is a 70% cotton 30% polyester string-knit glove with a PVC dip coating covering on the palmside from the wrist up to and over the backside fingertips. The PVC coating weighs less then 50% of the glove weight. The glove features a ribbed knit cuff with an overlock stitch finish.

Styles WG-107, WG-108, and WG-105 are string-knit gloves constructed of 70% cotton 30% polyester fabric in different colors. All feature a ribbed knit cuff with an overlock stitch finish.

Please note that pursuant to section 141.113, Customs Regulations (19 C.F.R. ยง141.113) and the Textile Fiber Products Identification Act (15 U.S.C. 70), textile and apparel articles are required to be marked or labeled with the fiber content, by percentage in descending order by weight, using generic terms. The applicable subheading for the styles WG-109 and WG-103 will be 6116.10.5510, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to cotton restraints. The duty rate will be 13.6 percent ad valorem.

The applicable subheading for the styles WG-107, WG-108, and WG-105 will be 6116.92.8800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of cotton: other: other: without fourchettes. The duty rate will be 9.7 percent ad valorem.

All styles fall within textile category designation 331. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
